Austin City Limits Music Festival "The Sound and the Jury" Contest 2008

NO PURCHASE NECESSARY TO ENTER OR WIN.
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The 2008 ACL Music Festival 'The Sound and the Jury' Contest ("Contest") begins at 12:00:01 a.m. Central Standard Time ("CST") June 27, 2008 and ends at 11:59 p.m. CST on September 24, 2008 ("Contest Period"). The Entry Period begins June 27, 2008 and ends August 22, 2008. In these Official Rules, "Sponsor" means C3 Presents, LLC and its employees, officers, directors, members, managers, sponsors, and agents. Dell Inc. is not a Sponsor of Contest. Sponsor or other companies associated with the promotion of the Contest (including but not limited to Dell Inc,) as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Entries submitted after Contest Period will not be considered or judged. The winner will be announced on or about September 24, 2008.
Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
How to Enter: During the Entry Period, visit www.DellLounge.com and follow the links and instructions to complete contest registration. Entrant(s) must submit one audio clip of originally created song. Entries may not contain any copyrighted elements other than elements owned by the entrant. Any elements that appear in the Entry, including without limitation images, music, audio, speech, or other audiovisual materials used must be entirely original, created and performed by the entrant, or be in the public domain. Use of any elements that are not original or in the public domain will result in disqualification of an Entry, in the Sponsor’s sole discretion. By submitting an Entry, you represent that (a) you are the creator of the Entry and (b) the Entry does not infringe the rights of any third party. Audio clip must be in mp3 format. You automatically will receive one (1) entry into the Contest.
Only the original author (and including the author's affiliated band members) who submitted the musical track may enter for a chance to win (in the event of a dispute as to authorship, Sponsor reserves the right to disqualify any entry, votes, or winner; Sponsor's decisions are final). Void wherever prohibited or restricted by law. Contest may only be entered from and in eligible jurisdictions. All federal, state, and local laws and regulations apply. By participating in the Contest, you are granting Sponsor and other companies associated with the promotion of the Contest an irrevocable right and license to publish, use, edit, reproduce, encode, store, copy, transmit, publish, post, broadcast, publicly perform, adapt, modify, exhibit and display any or all of the content in your submission, without further review or approval and with or without using your name, without territorial, time, or other limitations, for any and all purposes, including but not limited to, marketing, advertising, and promotional purposes. By participating in the Contest, you are also granting Sponsor and other companies associated with the promotion of the Contest the irrevocable right and license to use your name, image, and likeness for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes.
The Potential Winners will be selected by Sponsor in accordance with the published judging procedure that will be posted on www.DellLounge.com when the top 5 bands/artists are chosen. Alternative prize, cash, or other substitution is permitted except by Sponsor in the event of prize unavailability. Prizes are non-transferable. All federal, state, and local taxes are the sole responsibility of Winners. Except where prohibited, Potential Winner(s) will be required to complete and return an Affidavit of eligibility and a Release and license form (the "Affidavit/Release") within a required time period. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place according to the Judging Criteria.
Prizes:

- Tickets to Austin City Limits Festival (ACL) and a travel stipend
- Feature on www.DellLounge.com
(1) Winning Band/Artist will receive:
- Artist Passes to Austin City Limits Festival (ACL) plus hotel accommodations for the weekend in Austin.
- 11:45AM CT performance slot on the "Dell Stage" at ACL Friday, September 26, 2008.
- A Dell Studio 15 Laptop
Winners are responsible for all taxes and fees associated with prize receipt and/or use.
General Terms and Conditions:
By participating in the Contest, entrant agrees that under no circumstances, including, but not limited to, negligence, shall Sponsor, or other companies associated with the promotion of the Contest, and their respective officers, directors, employees, members, shareholders, agents, successors, and assigns (the "Released Parties") be liable for any direct, indirect, incidental, special, or consequential damages arising out of participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. By participating in the Contest, entrant waives any and all rights to bring any claim or action related to his/her/its participation in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based. By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor reserves the right to disqualify any person, entry, vote, or e-mail address that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor and their respective parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, unintelligible or postage-due entries, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result from participation in the Contest or arising from the entrant's access to and use of the Internet site http://www.delllounge.com/soundandjury/ (and all related websites of Sponsor, including www.austincitylimits.com and www.aclfestival.com), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Contest. Sponsor reserves the right to cancel, suspend and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
A winner's list will be posted at http://www.delllounge.com/soundandjury/, on the World Wide Web, at the conclusion of the Contest. To obtain a copy of the winner list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: The Sound and the Jury, C3 Presents, LLC, 98 San Jacinto Blvd, Suite 400, Austin, TX, 78701. Requests must be received no later than October 15, 2008.
